Subscription to FITM Borneo Facilities
  1. Only Fitness Innovations Malaysia (FITM) students with valid certification can subscribe to the gym facilities as part of FITM Borneo’s student support. With a Monthly subscription, your subscription fee is due on the 1st day of every month. All fees due shall automatically be deducted from your Visa/Mastercard on the 5th business day of every month. In case of any auto-debit failure, entries will be denied on the 10th. Arrears for gym subscription will be accumulated up to a maximum of one month and student would need to firstly clear off the owned arrears before being able to re-subscribe to utilise the facility.

    With a Yearly subscription, your subscription automatically ends at the end of the term stated in your subscription application form.

  2. Gym subscription may be cancelled by providing written notice at least 7 days before the start of the new month. You have the option to fill in a cancellation form which is needed to be countersigned by a FITM Borneo staff; or by emailing igniteedutraining@gmail.com. Your account must have no outstanding fees. In the event of dispute, only a written confirmation is accepted.

  3. Any paid subscription or course fees are non-refundable and non-transferable.

  4. The students hereby agree to abide by all safety guidelines and regulations while using FITM Borneo facilities and equipment. Some of as follows:

    • Throwing or not putting weights back after use

    • Any kind of vandalism

    • Not wearing proper sports attire

    • Consuming drugs, alcohol, or tobacco products in FITM Borneo

    • Trespassing (students or non-students)

        FITM Borneo reservves the right to revoke the student’s subscription if these terms are violated.

5. While we will be giving our best effort to ensure the comfort of the gym for our students, please acknowledge that you will be entering and making use of the gym at your own risk and will not hold FITM Borneo liable for any losses or damages howsoever caused.

Privacy Policy

This Privacy Policy sets out how Ignite Education & Training Sdn. Bhd. (Company Registration No. 1317727-X) of 1st Floor, Lot No. 12, Block C, Pintas Avenue, 88300, Penampang, Sabah, Malaysia.(hereinafter referred to as “We”, “Our” or “Us”) collects, uses and protects your personal information which you have provided to us in any manner. By engaging us to provide our services (“Services”) or by accessing our website at www.fitmborneo.com and/or any of our social medias such as Facebook, Instagram, Twitter, etc. (“Website”), you hereby consent to the processing of your personal information and/or further information in the provision of the Services to you.

COLLECTION OF INFORMATION

(1) We collect personal information when you:-
(a) use our Services;
(b) provide comments or submit an enquiry and/or problem to us;
(c) request information from us and provide your name or return contact information;
(d) join any contests or surveys organised by us; or
(e) register with us either through manual registration, Website, email or by connecting your social media accounts.

(2) We may process personal information such as:-
(a) your name, address, profile picture, contact details such as mobile number and email address;
(b) transaction details related to your use of our Services;
(c) usage and preference information;
(d) information generated from your participation in our survey or interaction with us in various other ways, such as demographic information, your comments, feedback, question or suggestions and information about a subject that may interest you; and
(e) information collected through the use of Cookies (as defined below).

(3) Your personal details are obligatory and if you fail to provide such information, we may not be able to provide you with the Services.

(4) Some of the information collected by us may not be explicitly submitted by you as we also automatically receive and record information on our server logs, including your IP address, cookie information, the pages or services you request, your browser type and language, access times, and/or the referring web site address.

(5) If you give us information about another person, you confirm that the other person has appointed you to act on his/her behalf and has agreed that you can:
(a) give consent on his/her behalf to the processing of his or her personal information;
(b) receive in his or her behalf any data protection notices; and
(c) warrant that you have obtained his/her consent for us to store his or her personal information or have the right to allow us to process his or her personal information.

COOKIES

(1) “Cookies” are data files that may be downloaded to your computer when you use the Website and permit the Website to identify your computer whenever you use the Website. We use cookies to recognise repeat use by users of the Website and to collect information about our users’ interactions with the Website. These cookies contain identification information that enables us to streamline your experiences using the Website.

(2) We may also use small pieces of code called “web beacons” or “clear gifs” to collect anonymous and aggregate advertising metrics, such as counting page views, promotion views, or advertising responses. A web beacon is an electronic image called a single-pixel or clear GIF. (1) In general, other than providing you with the Services and other services incidental or related to the Services, we may use the information provided to us for the following purposes:-
(a) process and manage the use of the Services;
(b) respond to your enquiries;
(c) create personalised promotions by combining your personal information with non-personal information about you;
(d) provide, maintain, protect and improve the Services, to develop new services, and to protect ourselves and the users of our Services;
(e) enforce any Terms and Conditions of use between us;
(f) research purposes including historical and statistical purposes;
(g) general operation and maintenance of the Website;
(h) provide you with regular communications from us relating to the Services; and
(i) investigation of complaints, suspected suspicious transactions and research for service improvement.

DISCLOSURE OF PERSONAL INFORMATION

(1) We may share your personal information with:-
(a) our subsidiaries and licensees and our parent and other affiliated companies for the purpose of developing or marketing new products and services that are developed by our related companies and informing you of such new products or services;
(b) service providers under contract who help with our business operations (such as merchants, partners, payment gateway provider, fraud investigations, bill collection, monitoring of user behavior and the processing of payments for any products or services, legal advisors, accountants and auditors);
(c) third parties (including those overseas) who provide data processing services; and
(d) any person, who is under a duty of confidentiality to which has undertaken to keep such data confidential, which we have engaged to fulfill our obligations to you.

(2) We may disclose your personal information if required to do so by law or if we have good faith belief that such disclosure is necessary to protect and/or defend our rights and interests. We may, as permitted by applicable law, disclose your personal information to third parties in connection with an investigation of fraud, infringement, piracy, tax avoidance and evasion or other unlawful activity and you expressly authorise us to make such disclosures.

(3) If we are merged or acquired by another entity, personal information may be transferred to such entity as a part of the merger or acquisition.

GENERAL

(1) This Privacy Policy is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.

Dasar Privasi ini menerangkan bagaimana Ignite Education & Training Sdn. Bhd. (Company Registration No. 1317727-X) yang beralamat di Tingkat 1, Lot No. 12, Block C, Pintas Avenue, 88300, Penampang, Sabah, Malaysia.( (selepas ini dirujuk sebagai “Kami”) mengumpul, menggunakan dan melindungi maklumat peribadi yang anda berikan kepada kami melalui apa jua cara. Dengan menghubungi kami untuk menyediakan perkhidmatan kami (“Perkhidmatan”) atau dengan melayari laman web kami di www.fitmborneo.com dan/atau mana-mana media sosial kami seperti Facebook, Instagram, Twitter dan lain-lain (“Laman Web”), anda dengan ini bersetuju untuk pemprosesan maklumat peribadi dan/atau maklumat lanjut anda dalam penyediaan Perkhidmatan kami kepada anda.

PENGUMPULAN MAKLUMAT

(1) Kami akan mengumpul maklumat peribadi apabila anda:-
(a) menggunakan Perkhidmatan kami;
(b) memberikan komen-komen atau mengemukakan persoalan dan/atau masalah kepada kami;
(c) meminta maklumat daripada kami dan memberikan nama anda atau maklumat perhubungan;
(d) menyertai apa-apa peraduan atau kaji selidik yang kami anjurkan; atau
(e) mendaftar dengan kami sama ada secara manual, Laman Web, emel atau menghubungkan akaun-akaun media sosial anda.

(2) Kami mungkin memproses maklumat peribadi seperti:-
(a) Nama dan alamat anda, gambar profil, maklumat perhubungan seperti nombor telefon bimbit dan emel;
(b) Maklumat-maklumat transaksi yang berkaitan dengan penggunaan Perkhidmatan kami;
(c) Penggunaan dan maklumat keutamaan;
(d) Maklumat yang diperoleh dari penyertaan anda dalam kaji selidik kami atau dengan pelbagai cara interaksi dengan kami, seperti maklumat demografi, komen-komen, maklum balas, pertanyaan atau cadangan-cadangan dan maklumat tentang subjek yang mungkin anda minati; dan

(3) Maklumat peribadi adalah wajib dan jika anda gagal untuk memberikan maklumat tersebut, kami mungkin tidak boleh membekalkan anda dengan Perkhidmatan kami.

COOKIES DAN WEB BEACON

(1) “Cookie” adalah fail data yang mungkin dimuat turun ke dalam komputer anda apabila anda menggunakan Laman Web dan membenarkan Laman Web tersebut mengenal pasti komputer anda apabila anda menggunakan Laman Web tersebut. Kami menggunakan cookies untuk mengiktiraf penggunaan ulangan oleh pengguna dan untuk mengumpul maklumat tentang interaksi pengguna kami dengan Laman Web kami. (d) memberi, mengekalkan, melindungi dan menaiktaraf Perkhidmatan kami, untuk membangunkan perkhidmatan-perkhidmatan baru dan untuk melindungi diri sendiri dan pengguna-pengguna Perkhidmatan kami;
(e) menguatkuasakan mana-mana Terma dan Syarat penggunaan di antara kami;
(f) tujuan penyelidikan termasuk tujuan-tujuan sejarah dan statistik;
(g) urusan dan penyelenggaraan umum Laman kami;
(h) membekalkan anda dengan komunikasi yang kerap daripada kami berkaitan dengan Perkhidmatan; dan
(i) menyiasat aduan-aduan, urus niaga yang mencurigakan dan penyelidikan untuk penambahbaikan perkhidmatan kami.

PENDEDAHAN MAKLUMAT PERIBADI

(1) Kami mungkin akan berkongsi maklumat tentang anda dengan:-
(a) anak-anak syarikat atau pemegang-pemegang lesen kami dan syarikat induk kami serta gabungan lain yang bertujuan untuk membangun atau memasarkan produk–produk atau perkhidmatan-perkhidmatan baru yang telah dibangunkan oleh syarikat-syarikat yang berkaitan dengan kami dan maklumkan anda tentang produk-produk atau perkhidmatan-perkhidmatan baru tersebut;
(b) pembekal-pembekal perkhidmatan di bawah kontrak yang membantu operasi perniagaan kami (seperti saudagar, peniaga-peniaga, rakan-rakan kongsi, pembekal gerbang pembayaran, siasatan penipuan, pengumpulan hutang, memantau tingkah laku pengguna dan pemprosesan bayaran untuk mana-mana produk atau perkhidmatan, penasihat undang-undang, akauntan dan juruaudit);
(c) pihak ketiga (termasuk yang di luar negara) yang menyediakan perkhidmatan pemprosesan data; dan
(d) mana-mana orang yang berada di bawah kewajipan kerahsiaan yang telah diamanahkan untuk menyimpan data secara sulit, yang telah kami lantik untuk memenuhi tanggungjawab kami kepada anda.

(2) Kami mungkin mendedahkan maklumat peribadi anda jika perlu untuk berbuat demikian oleh undang-undang atau jika kami mempunyai kepercayaan yang berniat baik bahawa pendedahan sedemikian adalah perlu untuk melindungi dan/atau mempertahankan hak-hak dan kepentingan kami. AM

(1) Dasar Privasi ini dikeluarkan dalam Bahasa Inggeris dan Bahasa Malaysia. Sekiranya terdapat apa-apa ketidakselarasan atau percanggahan antara versi Bahasa Inggeris dan versi Bahasa Malaysia, versi Bahasa Inggeris akan diguna pakai.

(2) Jika terdapat perubahan pada Dasar Privasi ini dalam apa jua cara, ia akan dikemaskinikan melalui halaman ini. Refund Policy

Refund Policy

This Refund Policy sets out how Ignite Education & Training Sdn. Bhd. (Company Registration No. 1317727-X) of 1st Floor, Lot No. 12, Block C, Pintas Avenue, 88300, Penampang, Sabah, Malaysia.(hereinafter referred to as “We”, “Our” or “Us”) deals with requests for refund of goods sold and/or services rendered.

Refund

All payments made for courses, exam fees, course materials and/or goods sold are non-refundable, non-transferable and non-exchangeable for cash.

Cancellation of Course

In the event of cancellation of a course by us for whatsoever reason, a full refund will be given to the participant who registered for the said course. Course confirmation will be sent within 14 days to the participant before the course begins. We shall not be held responsible for any other expenses that have been incurred by the participant with respect to the course.

Rescheduling of Course

Any registered participant who needs to reschedule his/ her course to a later date is subject to a modification fee of RM 110 with valid reason and supporting documentation(s) and at our sole discretion. The registered participant is required to contact us at (+60) 16 552 2435 or email to support@fitmborneo.com to ascertain that a later date is available for rescheduling purposes. It is the participant’s responsibility to contact us and follow-up on the rescheduling request if the participant has not received any reply from us within 14 days from the date of the request was made. Our decision is final and we shall not entertain any appeals thereafter.

Transfer of Course to Another Participant

Any registered course is not allowed to be transferred to another participant. Nevertheless, exception may be granted with valid reason and supporting documentation(s) at our sole discretion. The registered participant is required to contact us at (+60) 16 552 2435 or email to support@fitmborneo.com to ascertain the availability of seats and fulfilment of course pre-requisites. It is the participant’s responsibility to contact us and follow-up on the transfer of course request if the participant has not received any reply from us within 14 days from the date of the request was made. Our decision is final and we shall not entertain any appeals thereafter.

Modification of this Policy

We reserve the right to modify this Policy from time-to-time and without notice. You shall be responsible for reviewing and becoming familiar with any such modifications.

Terms of Use

The terms and conditions of this Agreement govern your use of the services (“Services”) provided by Ignite Education & Training Sdn. Bhd. (Company Registration No. 1317727-X) of 1st Floor, Lot No. 12, Block C, Pintas Avenue, 88300, Penampang, Sabah, Malaysia.(hereinafter referred to as “We” or “Us” or “Our”) in the event you proceed to purchase our goods and/or engage our services.

By using our Services, you are indicating that you have read, understood and agree to be bound by the terms and conditions herein.

Prices

All prices are expressed in Malaysian Ringgit (RM) (unless stated otherwise) and are subject to change without notice. We may offer options to transact in different currencies. All prices are also subject to the Goods and Services Tax as required by Malaysian law.

Payment

(1) Payment for orders can be made by cash, bank deposit/ transfer, cheque, PayPal or debit/ credit card. Goods will only be dispatched and services will only be rendered upon receipt of full payment for the cost of purchase and delivery charges, if any.

(2) Instalment plans for the purchase of our goods and/or payment for our services may be available. Please contact our Education Advisor for more details.

(3) Corporate pricing and bulk purchases/ discounts for our goods and services may be available. Please contact our Education Advisor for more details. Discounts, promotions and credits may not be combined with other offers and are not transferable. Additional restrictions may apply.

(4) Customised packages are available for educational institutions and health clubs that meet certain criteria. Pricing is based on volume and level of commitment. In the event a customised package does not require upfront payment in full in the agreement between the partner and us, failure by the partner to make complete and timely payments will result in the partner’s account being placed on hold and a suspension of access to our goods and services for the partner’s students and/or employees until full payment of the outstanding amount, plus any penalty (if applicable), have been received, processed and approved. Accommodation and Transportation

We do not provide ground transportation and accommodation support together with our Services.

Personal Information

When you use purchase our goods or use our services, we will collect, store and use certain information as described in our Privacy Policy.

Intellectual Property Rights

We do not claim any legal interest in trade marks, copyrights and/or other intellectual properties in the provision of our Services, save for those relating to our own “FIT” and “FITM” brands.

Marketing and Notifications

We will send you our newsletters containing advertisements and promotions, and/or those of our affiliates and partners if you have opted-in to receive them. You may unsubscribe by contacting us or using the unsubscribe option in the email updates that we forward to you.

Dispute Resolution and Governing Law

This Agreement will be governed by the Malaysian law and parties agree that any dispute or claim between you and us will be adjudicated in the courts in Malaysia. Any claim against us arising from the Agreement shall be adjudicated on an individual basis and shall not be consolidated in any proceeding with any claim or controversy of any other party.

Modification of this Agreement

(1) We reserve the right to change our terms and conditions herein from time-to-time and without notice. Nothing in this Agreement will constrain how we operate our business. You shall be responsible for reviewing and becoming familiar with any such modifications.

(2) If the alterations constitute a material change to our terms and conditions, we will notify you by posting a notification on our Website. Use of the services by you following such notification constitutes your acceptance of the terms and conditions as modified.

(3) What constitutes a “material change” will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.

General Terms and Conditions

(1) This Website is provided by us on an “As Is” basis. We will make reasonable effort to ensure that all prices, descriptions of goods and services and other information on this Website are correct. However, we cannot guarantee the accuracy of the information and make no warranties or representations of any kind, express or implied as to the operation of this Website or the information, content, materials or products included in this Website.

(2) We will not be liable for any loss or damage of any kind arising from the use of this Website and/or in the provision of our Services, including without limitation, direct, indirect, incidental, punitive and consequential loss or damage. We disclaim all responsibilities and liabilities (including for negligence) in relation to the information available on this Website and/or in the provision of our Services.

(3) You agree to indemnify and hold us, our partners, agents and employees, harmless from any loss, liability, claim or demand, costs or expenses of any kind, including solicitor’s fees and/or other fees or expenses, made by any third party due to or arising out of your use of this Website and/or in the provision of our Services.

(4) We do not have control of and cannot guarantee that any content on third party links from this Website will be safe from viruses, inaccurate information or inflammatory material.

(5) We may withdraw any goods for sale and alter prices, goods and or details of goods specifications at our discretion without notice.
